These conditions of sale are concluded on the one hand by the company Pest Free France SARL with capital of 37,500.00 euros whose head office is at 7 rue de Ribeauvillé, 68180 Horbourg-Wihr, registered in the trade and companies register, 10 rue des Augustins, CS 50466, 68020 Colmar Cedex, under number TI 789 741 949 hereinafter referred to as “Pest Free France” and on the other hand, by any natural or legal person wishing to make a purchase via the “Pest Free France” website Free France SARL” hereinafter referred to as “the buyer”.

Object

These conditions of sale aim to define the contractual relations between Pest Free France SARL and the buyer and the conditions applicable to any purchase made through the Pest Free France SARL merchant site, whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale.

These conditions of sale will prevail over any other general or specific conditions not expressly approved by Pest Free France SARL. Order

Shipping

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area. The risks are borne by the purchaser from the moment the products have left the premises of Pest Free France SARL.

In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery. Delivery times are given for information purposes only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Delivery delay

The maximum delivery time is 30 days from the Order, unless otherwise specified to or by the buyer, prior to validation of the order.

Delivery made or delivery note filed

Each delivery is deemed to have been made as soon as the package is made available to the buyer, as evidenced by the control system used by La Poste or the carrier. If the buyer is absent during delivery, a delivery notice will be left in his mailbox or sent by email. The buyer will then have 15 days to collect it from the Post Office or to contact the carrier. Late delivery or lost package

In the event of a delay, the buyer must contact their post office or consult the La Poste website (www.laposte.fr) or the carrier. If the package is found, it will immediately be sent to the buyer. If the package is not found, Pest Free France SARL will immediately reship it at its own expense. In any event, if delivery does not occur within the maximum delivery time indicated above, unless this delay in delivery is due to a case of force majeure within the meaning of French law and jurisprudence, the buyer has the right to cancel the Order concerned. In the event of cancellation of said Order, Pest Free France SARL will reimburse the sums collected within a maximum period of 14 days from the termination of the contract by the buyer, under the conditions provided for in article L.138- 2 of the Consumer Code.

Responsibility

Les registres informatisés de Pest Free France SARL seront considérés par les parties comme preuve des communications, commandes, paiements et transactions intervenus entre les parties.

Règlement des litiges

Les présentes conditions de vente en ligne sont soumises à la loi française. En cas de litige, compétence est attribuée aux tribunaux compétents de Colmar, nonobstant pluralité de défendeurs ou appel en garantie.
